Overview:
This position will work within the Legal Department and provide support to the Development team, managing all aspects of the company’s efforts to diligence and prepare the real estate component of utility-scale solar and storage projects for development and financing.
Core Responsibilities:
Lead preliminary real estate due diligence in support of project acquisition and development, including review and analysis of title commitments/reports, ALTA surveys, and mineral reports to identify any title curative actions
Identify, communicate, and resolve/mitigate real estate issues and risks related to the development of utility-scale solar projects located across the US
Support the Development team, as needed, on efforts to secure additional site control and/or any needed rights of way
Undertake efforts and collaborate with outside consultants to ensure mineral risks on projects are eliminated to secure affirmative title mineral coverage
Collaborate with the Development team, as needed, to facilitate third-party agreements including consents, rights-of-way, encroachment agreements, and other related real estate documents
Coordinate real estate efforts among Development team, attorneys, surveyors, title companies, and other key project stakeholders
Support the permitting, interconnection, and design aspects of the development and construction processes
Lead all of company’s surveying efforts with external consultants in support of development, construction, and financing
Support all efforts necessary for the underwriting and issuance of title insurance
Qualifications and Experience:
Bachelor’s degree; Master’s degree a plus
In-house expert, with extensive experience identifying real estate and title-related issues on renewables projects and with the proficiency to exercise independent judgment to resolve them
Independently track, organize, and prioritize workload schedule and complete according to project schedules
Minimum of five years of related real estate land acquisition and title experience
Experience with mineral rights and acquisition of mineral rights or waivers
Ability to review, interpret and comment on land surveys
Demonstrated experience in curing land title deficiencies and leading or supporting efforts for title insurance underwriting and policy issuance
Ability to work effectively with all functional groups, including Development, Project Management & Engineering, Legal, and Project Finance teams, from project inception through completion and operation, ensuring all aspects of real estate are satisfactorily covered
Job duties may involve occasional travel
